Welcome to Ellis County Trailer Rentals. By renting a trailer or using our website and services, you agree to the following Terms and Conditions:
1. Definitions

“Agreement” means these Terms and Conditions.

“Renter” means the person or business renting the trailer.

“Authorized Driver” means any person permitted to tow the trailer under this Agreement.

“Trailer” means the non-motorized trailer identified in your rental agreement.
-
“Loss of Use” means the loss of our right to rent the trailer during the time it is being repaired or replaced.
2. Rental, Indemnity, and Warranties

Renting a trailer creates a contract between Ellis County Trailer Rentals and the renter.

We may repossess a trailer at your expense if used illegally or in violation of this Agreement.

You agree to indemnify and hold Ellis County Trailer Rentals harmless from all claims, liabilities, damages, and expenses arising from your use of the trailer.

No warranties, express or implied, are given regarding merchantability, fitness for purpose, or condition of the trailer.
3. Condition and Return of Trailer

Trailers must be returned in the same condition as when rented, normal wear and tear excepted.

Late returns may result in additional charges.
-
Failure to return the trailer as agreed may result in repossession and additional legal/administrative costs.
4. Responsibility for Damage or Loss
-
You are responsible for all damage, theft, or loss to the trailer during the rental period, regardless of fault.

This includes damages caused by accidents, weather, misuse, or negligence.
-
All accidents or damages must be reported to Ellis County Trailer Rentals and local authorities within 24 hours.
5. Equipment Included
-
Tires, hitches, and equipment must be returned in the same condition.

You are financially responsible for missing or damaged equipment.
6. Prohibited Uses
You may not use our trailers for:

Transporting hazardous, illegal, or living items.
-
Towing by unauthorized drivers or under the influence of alcohol/drugs.
-
Exceeding the trailer’s rated capacity.
-
Towing outside the United States or Canada.
-
Driving under low clearances or unsafe conditions.
-
Using the trailer with an improperly secured load.
-
Defacing or damaging the trailer in any way.
7. Charges and Payments

You agree to pay all rental fees, mileage charges, taxes, fines, towing, or storage costs related to use of the trailer.

A $100 administrative fee applies if we must collect unpaid charges or recover a trailer.
-
A late fee of $100 or 5% of the unpaid balance (whichever is greater) may apply.
-
Cleaning fees up to $500 may apply if trailers are returned excessively dirty.
-
No refunds are given for early returns.
8. Deposits

A deposit may be required. Deposits are applied toward rental charges and any damage/loss fees.
9. Modifications
-
This Agreement may only be modified in writing by Ellis County Trailer Rentals.
10. Waiver
-
Failure by Ellis County Trailer Rentals to enforce any part of this Agreement does not waive our right to enforce it later.
11. Governing Law
-
These Terms are governed by the laws of the State of Texas.
